senz° general terms and conditions

General terms and conditions for senz° umbrellas - 4allweather umbrellas BV, hereinafter senz°. These general terms and conditions can be amended at any time without advance notification. Any purchase made after such an amendment entails acceptance by you as the customer of the new terms and conditions

1. accuracy of the information

The product and pricing information as well as the detailed order information available to you in the 'shop' has been compiled and published subject to changes and corrections. Updates to the contents of the 'shop' occur regularly, without you being explicitly informed thereof. Senz° endeavours, to the best of its ability, to provide the correct product information and accurately display the product colours. However, the weight, dimensions and volume of a product remain approximations and no guarantee is given that every monitor or screen displays a colour identically or that the colour does not, upon receipt of a product, deviate. Senz° cannot be held liable for the use of this website, including, without limitation, the content thereof and any errors

2. prices

All prices stated on the website are inclusive of VAT and exclusive of shipping costs. The currency is always stated clearly. It the price is incorrect or if the incorrect shipping costs are displayed, we shall inform you thereof as soon as possible. In that event, you can cancel your order free of charge.

3. ordering online

The ordering process involves the following steps:

  • Select your product and add it to the shopping cart;
  • Complete your billing address and, if it is different, the delivery address;
  • Complete the payment information;
  • You are asked to accept the general terms and conditions;
  • Prior to completing your order, you can view a summary thereof.
Once you have placed your order you will receive an email from senz° confirming receipt of your order. If you have paid by credit card you will also receive an email containing your payment status. As soon as your purchases are shipped you will receive a message with your invoice. All orders are subject to any stock fluctuations, and in the event of the unanticipated unavailability of an item we shall inform you. We reserve the right to cancel an order.

4. payment

The available payment methods are listed on the website. You shall be charged the sum in the currency you used to place your order. Please also refer to our privacy policy for payment methods using credit cards and related security matters

5. sales contract

A 'sale' means the online purchase of an item that is delivered to your home or to a collection point. Once you have completed your order the purchase is in effect and a payment obligation exists. Your order will only be sent once payment is received.

We shall not ship an order in the following cases:

  • if there is a strong suspicion of abuse of rights or poor faith on the part of the customer;
  • if we are out of stock or if an article has been discontinued;
  • if we establish that an invalid offer has been published;
  • in the event of force majeure.

6. restrictions for shipping

Please note that there are a number of restrictions on shipping:

  • post box addresses may not be used.
  • orders are not delivered on Saturdays; deliveries are performed from Mondays to Fridays only, excluding public holidays.

7. deliveries

Products are only shipped in those countries stipulated for deliveries on the website. Deliveries shall be performed, insofar as is possible, within the time period stated on the individual order confirmation. Any delays shall under no circumstances lead to compensation being payable. The user is liable for incorrectly supplied delivery addresses and this could lead to further costs that shall be recovered from the user.

All orders are shipped from senz°. If you have not received your order in good time, please contact us at care@senz-umbrellas.com, stating your order number. If, due to exceptional circumstances, we are unable to ship your order within 14 days of receipt of the order confirmation email, then you can cancel your order free of charge and we guarantee to refund you within 14 days.

Deliveries are always performed by a professional courier service. You are required to sign for your order prior to taking receipt of it. You accept that an order can be delivered to a person other than the person placing the order if that person is available at the address you provided. If nobody is present at the time of delivery, a new appointment will be made.

8. defective product or incorrect order

Inspect the articles immediately after receipt of your order. If you believe that the articles do not comply with your order, do not sign the delivery note and/or clearly state the issue on the courier company's document. Please inform us of the issue, together with your order number, within 24 hours at the following email address: care@senz-umbrellas.com. If the defect is a manufacturing error on the part of senz°, or if senz° shipped the incorrect articles to you, then senz° shall pay the shipping costs for returning the products.

9. remote selling

As a consumer you have the right to inform senz° that you are declining your purchase, without being liable to pay a penalty and without being required to state the reasons therefor, within 14 days, starting on the day following the day upon which your order was delivered. Articles designed specifically for you are not accepted for return and you cannot invoke the withdrawal clause for such articles.

Should you wish to exercise this option, you are required to return the articles to senz° at your own expense and risk.

Returned articles will only be accepted by senz° on the condition that they are unused.

The following procedure must be followed for returning articles:
  • Step 1: Contact care@senz-umbrellas.com and state your order number. We shall email you the instructions for returning your order. You are responsible for the costs for return shipping, which we will state in this email.
  • Step 2: Replace the articles to be returned in their packaging (only return unused articles in their original packaging together with all the original labels, accessories, instructions for use and guarantees). The original packaging will also help to prevent the articles being returned from getting damaged.
  • Step 3: Print the return form and include it in the box/boxes. The received form will contain all the information for properly returning articles (your details, our delivery address and the name of the courier company).
  • Step 4: If you have any queries after completing step 3, please don’t hesitate to contact us. If you have no queries, then the articles must be returned to us within seven days.
  • Step 5: If we receive the articles as set out above, then you will receive a refund within 14 days. If we receive incomplete or damaged articles, we will contact you.

Only those articles purchased online can be returned by courier. For any other returns, please visit the store where you purchased the articles.

10. limitation of liability

Using the website: senz° is not liable for the website being inaccessible or access not being granted to the website, nor for disruptions caused by the computer system, viruses or other issues that could arise through the use of this website (including but not limited to 'loss of profits').

a. Statutory guarantee:
The statutory guarantee for consumers is 2 years. This guarantee only covers a lack of conformity that already existed at the time of the articles being delivered. For the duration of the aforementioned period, senz° undertakes to replace or repair the defective article (or component) free of charge. Senz° reserves the right to exchange the article if the repair costs are disproportional or if the article cannot be repaired. Defects that emerge after a period of 6 months after delivery are not deemed to have existed at the time of delivery, subject to the customer demonstrating otherwise.

b. Exclusions:
Under no circumstances shall the guarantee apply to defects that arose as a result of accidents, the aggravation of the article's conditions due to negligence or being dropped, use of the article that conflicts with the purpose for which it was designed, noncompliance with the user instructions or manual, modifications or changes to the appliance, poor treatment, incorrect assembly, poor maintenance or abnormal, commercial or incorrect use.

Nor is the guarantee applicable to articles with a short lifespan (such as batteries, articles that wear out quickly or articles with a short shelf-life) or in the event of a third party not designated by the seller working on it.

Use of the articles: senz° is not liable for material or other damage, irrespective of the nature, sustained by the user or a third party through the use of the articles.

Delivery and other exclusions: senz° cannot be held liable for noncompliance with any timeframes whatsoever, given that such timeframes are solely indicative and do not entail any obligation whatsoever on the part of senz°, nor for any other damage due to senz° as a result of an error or other failure on its part, even in the event of serious fault. Any consequential loss or any damage whatsoever that cannot be anticipated at the time of the sales contract being concluded is excluded from compensation.

Full liability on the part of senz° shall never exceed the purchase price of the product in question.

11. use of information on/via the website

You are prohibited from amending, copying, reproducing, downloading, disseminating, transferring or commercially exploiting and/or sharing the services, the pages of the website or the programme codes pertaining to the website.

Information and suggestions provided to us via the website can be used non-bindingly by senz° and without any compensation being payable.

12. termination

Senz° can terminate the sales contract at any time without providing advance notification thereof.

13. legislation

Disputes concerning entering into the contract, its validity or the interpretation or the performance thereof or of the current terms and conditions are governed solely by Dutch law and fall under the exclusive jurisdiction of the Court of Breda, notwithstanding your right as a consumer to bring a dispute before the courts that are competent on the grounds of a mandatory statutory provision. Within the context of their relationships, all the parties accept electronic evidence (such as emails, backups, etc).

If one of these provisions is nullified or deemed to be inapplicable, the other provisions shall remain in full effect and that provision shall be applicable to the extent permitted under the law.

14. conclusion

These general terms and conditions replace all previous agreements concluded with you as the user.
